Level Up Contractors, Inc. ("Company," "we," "us," or "our") reserves the right to update, modify, or replace these Terms of Service at any time without prior notice. Your continued use of the Site after any changes constitutes your acceptance of the revised terms. We encourage you to review this page periodically.

These terms apply to all visitors, users, and others who access or use the Site. By using this Site, you represent that you are at least 18 years of age or are accessing under the supervision of a parent or legal guardian.

Services and Estimates

Level Up Contractors, Inc. provides residential and commercial construction, renovation, and roofing services. The following terms apply to all services and estimates:

  • Estimates: All estimates and quotes provided by us are valid for 30 days from the date of issuance unless otherwise stated in writing. Estimates are based on information provided at the time and are subject to change upon further inspection or discovery of additional work required.
  • Written Contracts: All projects exceeding $500 in total cost will be documented in a written contract signed by both parties before work commences. The contract will detail scope of work, timeline, payment schedule, and warranty terms.
  • Permits: Level Up Contractors, Inc. will obtain all necessary permits required for the project unless otherwise agreed upon in writing. Permit fees are not included in estimates unless explicitly stated.
  • Change Orders: Any changes to the scope of work after the contract is signed must be documented through a written change order, approved by both parties, and may affect the project timeline and cost.

Payment Terms

The following payment terms apply to all projects unless otherwise specified in your written contract:

  • Deposits: A deposit of no more than 33% of the total project cost may be required to schedule your project and order materials. This deposit is non-refundable once materials have been ordered.
  • Progress Payments: Interim payments may be scheduled at specific project milestones as outlined in your contract. Each payment is due upon completion of the specified milestone.
  • Final Payment: The final payment is due upon substantial completion of the project and before final walkthrough. A detailed invoice will be provided listing all completed work.
  • Accepted Payment Methods: We accept checks, cash, credit cards, ACH transfers, and financing through approved third-party lenders. A 3% processing fee may apply to credit card payments.
  • Late Payments: Payments not received within 15 days of the due date may be subject to a late fee of 1.5% per month (18% APR) on the outstanding balance.

Important Notice

All payments must be made directly to Level Up Contractors, Inc. Never make payments to individual workers or subcontractors. Always request a receipt for any payment made.

Warranty and Liability

Level Up Contractors, Inc. stands behind the quality of all work performed. Our warranty terms are as follows:

  • Workmanship Warranty: We provide a minimum 5-year workmanship warranty on all labor performed, with extended warranties available on certain services as specified in your contract.
  • Manufacturer Warranties: All materials installed are covered by the manufacturer's warranty. We will facilitate any manufacturer warranty claims on your behalf.
  • Limitations: Our warranty does not cover damage resulting from normal wear and tear, improper maintenance, acts of nature (including hurricanes, floods, and other severe weather events), or alterations made by third parties.
  • Liability: Level Up Contractors, Inc. carries comprehensive general liability and workers' compensation insurance. Certificates of insurance are available upon request prior to the commencement of any project.

Website Use and Intellectual Property

The following terms govern your use of the Level Up Contractors, Inc. website:

  • Content Ownership: All content on this Site, including but not limited to text, images, graphics, logos, icons, videos, and software, is the exclusive property of Level Up Contractors, Inc. and is protected by United States and international copyright laws. Cancellation and Dispute Resolution

The following terms govern cancellation of services and resolution of any disputes:

  • Right to Cancel: Under Florida law, you may have the right to cancel certain contracts within three (3) business days of signing. This right will be clearly disclosed in your contract if applicable.
  • Cancellation by Client: Cancellation after the 3-day period may result in forfeiture of deposits and payment for work already completed and materials already ordered. All cancellations must be submitted in writing.
  • Cancellation by Company: We reserve the right to cancel or refuse service to anyone for any lawful reason, including but not limited to safety concerns, non-payment, or hostile work environment.
  • Dispute Resolution: In the event of a dispute, both parties agree to first attempt resolution through direct negotiation in good faith. If direct negotiation fails, the parties agree to participate in mediation before pursuing any other legal remedies.
  • Governing Law: These Terms of Service and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action shall be brought in the courts of Miami-Dade County, Florida.

Limitation of Liability

To the fullest extent permitted by applicable law:

  • Level Up Contractors, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services.
  • Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
  • We make no warranties, express or implied, regarding the Site's accuracy, completeness, reliability, or uninterrupted availability. The Site is provided on an "as is" and "as available" basis.
  • Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless Level Up Contractors, Inc., its officers, directors, employees, agents, contractors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of and access to the Site
  • Your violation of any of these Terms of Service
  • Your violation of any third-party rights, including but not limited to intellectual property rights or privacy rights
  • Any claims that information you submitted caused damage to a third party

Insurance and Licensing

Level Up Contractors, Inc. is a fully licensed and insured contractor in the State of Florida. We carry:

Insurance

General liability insurance ($2,000,000+) and workers' compensation coverage. Certificates provided upon request.

Updates to These Terms

We reserve the right to update or modify these Terms of Service at any time. When changes are made, we will:

Material changes may be communicated to existing clients via email. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms of Service.
